The Tort of Negligence Case Study

First of all, Brandon didn't read the instruction paper before signed. So, he could not take any action after any injuries. Secondly, he didn’t check that equipment after wearing. He wanted to get his destination as soon as possible. The third one is on the rocky surface tile. There was not any signboard that could help people to aware about the rocky surface. But, if Brandon listens to that person who was there to aware the people about the rules and regulation then Brandon can get that information.

There are a number of negligence action that occur over there. Firstly, Brandon was in too much hurry and he signed that bond without reading. On the top of that paper, there was especially noted that READ BEFORE SIGNING, but he didn't care about that and just sign. Secondly, when the attendant gave him the saddles and riding equipment he also didn't check that. The attendant was busy in other people and he just gave that equipment to Brandon. On the other side, Brandon just wore that and didn’t care about that notice (All riders must have their harnesses, saddles, and riding equipment checked by a Hoof Hearted Adventures Ltd. employee before departure). Brandon just started his ridding. Lastly, near the rocky surface, there was not any signboard for riders to aware of an accident.

Hoof Hearted Adventure had an excuse against Brandon. The paper that Brandon signed up, there was specially mentioned that all equipment should be checked after wearing. Moreover, in the starting, Hoof Hearted said that there should not be any responsibility of our team if any customer got injuries. No, that was just because of Johan. Bowling ally did their responsibility and they provide the signboard of caution on the top of stairs. That was johan’s mistake as he didn't care for that caution board. He was in a hurry as he wanted to get his destination very early

Five important pieces of evidence- a. a waiver was one of the most important evidence that showed the carelessness of Brandon as Hoof Hearted provide him the paper of instruction but he didn’t care about that.. Brandon also can claim that the ridding equipment was not as good as that were damaged. There were a lot of people who were there for ride and attendant was also busy with other customers as he was explaining everything to that people. It was not possible for him to handle one by one person. There was a board of signing that showed that people should check their equipment before leaving. e. However, there was not any signboard as a caution of the rocky surface.
