There has been an increasing need to have the certification course due to the lack of clear guidelines on how to implement the requirements and expectations of the Department of Education at the education institution levels (Rhode, 2007). In order to fill up the alignment gap between the two major stakeholders of the certification, this paper will closely look at the source, reason, review and analyze Title IX.
Title IX is an education legal amendment enacted in 1972, which outlaws discrimination based on gender and sex in any federal institution or federally funded activities (Simon, 2012). To ensure and maintain diversity in education institutions there is need to create awareness on the stated regulations of the amendment. For this reason, there are Title IX Coordinators who are certified. Title IX Certification is a course that is meant to teach the coordinator about their roles in a school setting, how to make the school comply with the amendment and to oversee investigations on the same (Simon, 2012).
Title IX certification is very important in a federal institution and its activities because it offers an equal platform to all students and participants without bias. Talent realization and management is possible in such a platform. It also ensures that the institution is conforming to the legal terms and conditions. These conditions include but are not limited to; the institution must have at least one Title IX coordinator whose name, office number and address and role will be clearly communicated to all the other employees and students for ease of access. The institution should also have a clearly written policy against discrimination on the grounds of gender and sex (Simon, 2012). This policy must be signed by each and every student and employee upon being admitted or employed to the institution.
The Title IX coordinator has the role of receiving grievances and communicating it to the necessary authority. He/she also distributes the grievances form to ensure that the affected know how they can access the office (Rhode, 2007). The coordinator should hold training sessions regularly and ensure that the amendments requirements are upheld. He/she should attend the federally funded activities that the institution is involved in and ensure that the personnel policies are also in line with the amendment.
The coordinator even after being certified and understanding the requirements of the amendment and how it can be implemented, there are several traits that he/she should have. The coordinator should be discreet because gender based discrimination and sexual harassment is a very sensitive topic and if the grievance is not properly handles the issue may never be fully resolved and might make others to shy away even though they may be suffering (Simon, 2012). The coordinator should be able to properly communicate with the students and personnel by being articulate and give clear and relevant speeches whenever called upon by the institution. Should be able to manage a situation and create a positive atmosphere for the grievances to be forwarded (Simon, 2012). Finally the coordinator should be able to diagnose a situation and find the appropriate solution. Some of these traits can be trained and learnt over time but some are inborn.
Title IX ensures that there is federal funds that are a product of the citizen’s taxes are not used discriminately to favor one gender against the other. Additionally, the amendment is meant to protect students and employees in education institutions from being harassed for sexual favors in return for what they are entitled to. The Department of Education ensures that all federally funded educational institutions are accountable to federal government.
